Attorney review is a short window after a Chicagoland contract is signed in which each side’s real estate attorney reviews and may negotiate changes. It is typically five business days, and while it is customary here, it is not required by Illinois law.

How the process works

Once the buyer and seller agree on price and terms, the contract is signed and attorney review begins. Each attorney reads the contract, may propose changes, and the two sides negotiate. If attorneys cannot reach agreement within the review period, either side may be able to end the contract, depending on its terms.

What your agent does and does not do

Your REALTOR® helps you negotiate the business terms and keeps the transaction on schedule. Interpreting contract language and giving legal advice is your attorney’s job, which is one reason to line up an attorney before you start touring homes.

Tips for a smoother review

  • Choose your attorney early so you are not searching while the clock runs.
  • Put every request in writing and keep an eye on the deadline dates in your contract.
  • Ask your attorney which items they review, such as the title commitment, survey and any association documents.
